Fred Maldonado has filed a lawsuit against In-N-Out Burger, a California-based fast food chain, alleging he fell ill after discovering two capsules filled with methamphetamine and a napkin at the bottom of his cup, My News LA reported.

“Plaintiff did not initially know what the two capsules were, but later testing revealed that they were methamphetamine and that it appeared that they may have been illicitly manufactured,” the suit states. 

Maldonado, who allegedly discovered the capsules at the bottom of his cup on March 10, 2014, the day after he had his meal, claimed he suffered from mental distress and nausea after he consumed the drink, CBS Los Angeles reported.

The suit claims Maldonado returned to the In-N-Out restaurant in Downey, California, where he bought the meal, to complain to the manager. The manager reportedly offered him a certificate for a free burger and an apology. Maldonado is now seeking unspecified damages.

In-N-out plans to fight the claims.

“We will vigorously defend these baseless claims. Due to the fact that this matter involves ongoing litigation, we will unfortunately not be able to comment any further,” said Executive Vice President Arnie Wensinger.
